nineteen hundred eighty-five. Notwithstanding the provisions of section 92-i of the

state finance law or any other law to the contrary, upon receipt of the certification of the commissioner of taxation and finance provided for in subdivision four of such section 92-i for the calendar quarters ending September thirtieth, nineteen hundred eightyfive, December thirty-first, nineteen hundred eightyfive and March thirty-first, nineteen hundred eightysix, the comptroller shall determine the amount payable by the state as one-half of the revenue loss to the city of New York for such calendar quarter as rebates of stock transfer taxes and the expiration of the twenty-five percent surcharge on transactions subject to the stock transfer tax. Upon making such determination, the comptroller shall

forthwith pay into the stock transfer incentive fund an amount equal to the lesser of the amount so determined or the difference between the total appropriation herein provided and the amounts determined to

be payable into the stock transfer incentive fund on October fifteenth and December fifteenth, nineteen hundred eighty-five. In no event shall the amount paid into the stock transfer incentive fund exceed the amount appropriated herein ... 117,600,000

special law, no part of such appropriation shall be available for the purposes designated until a certificate of approval of availability shall have been issued by the director of the budget and a copy of such certificate filed with the state comptroller, the chairman

of the senate finance committee and the chairman of the assembly ways and means committee. Eligible institutions that have a master plan for a capital construction program that has not been completed, and have previously received financial support from the Natural Heritage Trust for capital improvements may, at the institution's discretion, use any funds awarded from the Trust to further its capital construction program pursuant to its master plan
