at his own expense suitable landmarks of stone or iron at the corners thereof, and shall cause the number of the lot to be legibly and permanently marked thereon; and if the proprietor shall neglect for thirty days after notice to comply herewith, said commissioners are authorized to cause the same to be done at the expense of the proprietor.

4. That the proprietor of said lot shall have the right to erect monuments, cenotaphs, or stones commemorative of the dead, and to cultivate trees, shrubs, and plants in the same; but if any trees, shrubs, or plants in said lot shall become in any way detrimental to the adjacent lots, avenues, or paths, or dangerous or inconvenient, it shall be the right and duty of the commissioners for the time being to cause the same, or so much thereof as may be thus dangerous, detrimental, or inconvenient, to be removed.

5. That if any monument, effigy, cenotaph, fence, or other work or structure whatever, or any inscription, be placed in or upon said lot, which shall be determined by said commissioners for the time being to be offensive or improper, it shall be the right and duty of such commissioners to cause said offensive or improper object or objects to be removed. No tomb shall be constructed or allowed within the bounds of said cemetery except by special permission of said Board of Commissioners, and then shall be constructed and kept only in such place and manner as they shall direct. No proprietor shall ever suffer the remains of any person to be deposited in his tomb or lot for hire.

6. Said lot shall be indivisible; and in case there shall be more than one heir-at-law, devisee, or grantee of said lot at any time, said commissioners shall have the right to designate from time to time which of them shall have the right of using said lot until the commissioners shall make another designation.

7. The said lot shall be holden forever, subject to all bylaws, rules and regulations made and to be made by said Board of Commissioners, consistent with the authority to them granted by any act or acts of the legislature of the Commonwealth.

And the said City of Boston hereby covenants to and with the said heirs and assigns that said city is lawfully seized in fee simple of the said granted premises and of the ways leading to the same from the highway; that said premises are free from all incumbrances; that said city hath good right to sell and convey the same to the said grantee heirs and assigns, in the manner and for the purpose aforesaid, and will warrant and defend the same unto the said grantee heirs and assigns, forever.
