DEAR MR. FAHY: I have your letter of November 21 regarding your letter of November 13 setting forth information concerning the policy of the Board with respect to making a case a Board case.

I note in the second paragraph that the Board "has sometimes, but rarely, transferred to itself for decision without an intermediate report, cases in which protests have been received of the manner in which the trial examiner has conducted the hearing." Will you please furnish me with the list of cases where this has happened and have come within this classification?

With further reference to your letter of November 21 and the enclosed list, will you please advise me the name of the Trial Examiner in each case listed thereon. The list carries the name of the Board Attorneys and the Review Attorneys, but does not carry the name of the Trial Examiner, if any. Very truly yours,

There have been no instructions which I believe cover this precise matter. You are no doubt familiar, however, with the provisions of the statute on the subject and the provisions of Article IV of the Rules and Regulations of the Board.
