Chairman, Special Committee to Investigate the National Labor Relations Board,
House of Representatives, Washington, D. C.

DEAR MR. SMITH: At the hearings before the Committee on February 28, 1940, at Volume III, page 206, column 3, of the verbatim record of the proceedings, in the testimony of Allan R. Rosenberg, called by the Board, there were admitted in evidence and authorized to be printed as exhibits certain resolutions and other documents, listed at pages 201-205 of the record, by unions affiliated with the American Federation of Labor, together with the correspondence between the Board and the unions involved relating to these resolutions and documents. The record also shows at page 206, column 3, and page 207, column 1, that you agreed to the introduction and printing of the documents, subject only to the elimination of immaterial matter from the files containing the correspondence and resolutions. All of the material in question has been in the possession of the Committee for several weeks, and as vet it has not been printed. May I respectfully urge that the Committee immediately publish these documents as exhibits in its official record.

DEAR MR. TOLAND: This will acknowledge your letter of April 11, 1940 requesting that before the documents that you now have are "introduced and made as exhibits," you be furnished with all of the covering letters between the Board and the A. F. of L. unions which passed resolutions opposing the proposed amendments to the Act.

On February 28, 1940, the Chairman of the Committee directed that, subjert to the clearing out of immaterial matter, the documents which the Committee has in its possession be admitted in evidence. The immaterial matter was removed from the exhibits and the documents were admitted in evidence as N. L. R. B. Exhibits 229 to 234 and Committee Exhibits 1087 to 1092 at page 207 of Volume III of the proceedings.

I see no reason for the failure to print these exhibits in the same way, and with the same dispatch, that other exhibits, properly admitted in evidence, have been printed; or for conditioning their printing on the receipt of other material I again respectfully request that these exhibits, duly admitted in evidence, take their place in the official record to which they have been admitted and be printed Yours very truly,
