Motion Picture Producers that present negotiations are in violation of spirit and letter of Act, has led to intense resentment on the part of workers and general widespread belief that no fair election is possible under present circumstances. We feel that unless Producers publicly announce no negotiations will take place until certification of collective bargaining agent we will have no alternative but to immediately file charges of discrimination, assistance to I. A., and general interference with free choice of bargaining agent. We peresctfully urge your immediate action. Please advise.”

Please investigate and report promptly. Also, if the Companies have announced negotiations with or concessions to IATSE, advise Companies immediately that such action constitutes a gross interference with the election and that a public disclaimer of any such action prior to the election is necessary to insure a fair election.

Re: Columbia Pictures, XXI-R-621, R-1466, review stipulation paragraph seven, contract between Producers and IATSE, paragraph four, telegrains from Robertson' USTG, to Witt, Witt to me, and my reply. Also consult Pratt who is familiar with case. I believe we are bound by stipulation and any statement by Board and myself re negotiations between Producers and IATSE would cause much mischief. Counsel against Board making any statement or requiring me to advise.

Retel September 14th and 15th, Columbia Pictures, XXI-R-62, R-1466, re Robertson's protest of negotiations, present negotiations by Companies and IA are proceeding underparagraph four of contract. Prior to stipulation, Katz, USTG counsel, tried to get IA and Producers to agree to postpone negotiations pending election. Producers and IA refused which resulted in paragraph seven of stipulation. In conference yesterday between Robertson, USTG, Alfred Wright Producers' counsel and myself, Wright stated although negotiations were in progress, that he believed Producers would not grant concessions or increases to IATSE prior to election. Spreckels and I agree that any public statement by myself or Board will be interpreted by IATSE as breach of stipulation and that IATSE will immediately, under strike threat, force the signing of contract granting increases and concessions which will prevent a fair election and give grounds for contest. USTG has atempted to get me to make a statement that negotiations are a violation of the spirit and letter of the stipulation. I declined. After yesterday's conference, it would appear that Robertson is attempting to get the Board to make a statement to further their own cause, which in my opinion would be dangerous. Please reconsider instructions. Advise.

Sec., National Labor Relations Board, Washington, D. C. Re Columbia Pictures, XXI-RR-621. R-1466, I. A. T. S. E. has just given the following press release: "Dated September 15, 1939. Charges have been recently made by our enemies that the purpose of the IATSE in attempting to negotiate for wages, hours and working conditions near the eve of the forthcoming NLRB election in the studios is in order that the result of such negotiations would react favorably in behalf of the IATSE in such election. Such propaganda is vicious, untrue and typical of the source from which it springs. We also assure our members and friends that the IATSE does not have to stoop to the things as charged against us in order to win the forthcoming election. We know that the IATSE will win in a fair and honorable manner.' "We best demonstrate the falsity and the unfairness of the said baseless charged now by voluntarily requesting the Producers to postpone all negotiations with the IATSE until the day after the said election, namely, September 21, 1939." USTG still pressing us for a clarifying statement, claiming IATSE's statement another effective maneuver. We will endeavor to have Producers make statement that negotiations have been called off in order to insure fair election. Will keep you advised.

Natl. Labor Relations Board, Washington. On Friday evening Producers and IATSE finally yielded and called off negotiations. However when IATSE made the announcement and Producers said nothing USTG considered the whole thing a trick by IATSE in order to show their strength. USTG threatened to file formal charges unless Producers made statement that negotiations have been halted until after election on September 21st and further announce that they will bargain collectively with whatever bargaining agency is finally determined by law to be the legal agency. After lengthy conferences on Saturday with IATSE representatives they finally withdrew their objections to a Producers' statement. Mister Schenk President of Producers' Association then agreed to make such a statement which appeared in the Sunday press. He also agreed to post this statement in studios. USTG now appears satisfied and I hope that all will remain quiet until day of election. Walter P. Spreckels, Regional Director, 21st Region.

DEAR SIR: Your charge against Los Angeles Examiner charging a violation of Section 8, sub-sections (1) and (3) of the National Labor Relations Act, has been duly investigated. Our investigation reveals that the unfair labor practices of the case are not sufficiently strong to warrant the issuance of a complaint by this office. I must therefore refuse to issue a complaint in this matter and am herewith closing the case.

Please be informed that, pursuant to the Rules and Regulations, Series I. Article II, Section 8, of the National Labor Relations Board, you may obtain a review of this action by filing a request therefor with the Board in Washington, D. C. and by filing a copy of such request with me.
