Chicago, Illinois plant to Brazil, Indiana. When the plant in Brazil, Indiana which was a branch plant of the Chicago plant, was closed down the work was transferred to Chicago. The moving of all the operations to Brazil, will, of course be of substantial advantage to the employees at Brazil. The contract entere! into contemplates a closed shop arrangement for all the employees of the company. The contract is also between Abraham Baum, as owner of the Brazil Manufacturing Company, and the union. At the time of the hearing of this case the conpany contended that a Mr. Greenfield was the owner of the Brazil Manufacturing Co., and refused to enter into any agreement except in the name of Greenfield. The signing of the contract with the real owner is, of course, an advantage to the union.

2. The company has agreed to offer employment and reinstate all the individuals who were employed at the Brazil plant immediately upon the resumption of operations.

3. The company will post the required notices.

4. The union and the company have agreed on the sum of $3,000 as the amount which would substantially make whole to the employees who were locked out, the amount of money which they would have earned if the plant had operated in Brazil, Indiana. This figure, on the face of it, seems very inadequate; however, the union and the company have stated to us the following:

(a) The average weekly wage at the time of the lock-out was not more than $5.00 or $6.00; the normal operating period in the cotton goods industry is not more than 36 to 40 weeks per year;

(b) There are 3 employees on the list who were not working at the time of the lock-out and who have not suffered any loss;

(c) There are 3 employees who were working on school permits and would normally have gone back to school at the end of a month or so;

(d) There are about 6 or 7 employees who have received employment since the lock-out and whose earnings amounted to more than what they would have earned while working for the company:

(e) The union has taken the matter up with each and every employee and the local has voted to accept this amount of money, and feel that it will compensate them for whatever loss they have suffered.

In view of the substantial advantages gained by the union as a result of this settlement, and in view of the delicate issue of the question of the lock-out of the employees, I recommend that this offer of settlement be approved by the Board. Since the resumption of operations at the plant in Brazil, Indiana, are dependent upon the approval of the Board of this settlement, I wish to urge that this matter be speedily presented to the Board and an answer given us as quickly as possible. A copy of the agreement, which has been entered into between the compan and the union, is hereto attached.
