NATIONAL LABOR RELATIONS BOARD,

The committee met at 10:10 a. m., pursuant to adjournment on Monday, May 6, 1940, in room 362 of the old House Office Building, Representative Howard W. Smith, chairman, presiding.

Present: Representatives Howard W. Smith of Virginia and Abe W. Murdock of Utah.

Edmund M. Toland, general counsel to the committee.

Charles Fahy, general counsel to the National Labor Relations Board.

The CHAIRMAN. All right.

Mr. TOLAND. Mr. Chairman, before we proceed I should like to file with the committee a copy of the decision of the Ninth Circuit Court of Appeals in the case of National Labor Relations Board v. Sterling Electric Motors, Inc., decided by that court on May 7, 1940.

(Decision of Circuit Court of Appeals for the Ninth Circuit, case of N. L. R. B. v. Sterling Electric Motors, Inc., May 7, 1940, was received in evidence, marked "Exhibit No. 1445" and was filed with the committee.)

Mr. FAHY. Mr. Chairman, I don't know why that particular decision of the court should be picked out to be put in the record.

The CHAIRMAN. We are not putting it in the record. It is being filed as an exhibit.

Mr. FAHY. Could I state that in my opinion, the decision of the court in that case is an attack not only on Congress, but it defies previous decisions of the Supreme Court of the United States. The CHAIRMAN. Not having seen the case

Mr. TOLAND (interposing). I didn't offer it for the purpose of Mr. Fahy to make a speech. I am offering from time to time different decisions of the Board and the courts. Sometime when I get to it, I hope to offer all of the decisions of the Board as well as all of the decisions of the courts in cases that the Board has been involved in. The CHAIRMAN. All right, let's get along.
