SEC. 7. The baking of bread, cakes, pies, the manufacturing of candy, or the cooking of other food is prohibited from being done in a cellar or basement or other room where there is no direct ventilation to the outer air.

It shall be unlawful for any person to sell, or offer for sale, any bread, cake, pastry, or other baked food products, having attached to it a label or stamp, which is affixed thereto by any foreign adhesive substance.

SEC. 8. Any person or persons owning or managing or in charge of any canning establishment or other place where meats, fish, oysters, fowls, fruits, vegetables, or other foods are canned or preserved for human consumption, who shall keep or conduct said places in an unclean, unwholesome, or insanitary manner; and any person canning, curing, or otherwise preserving any meats, fish, oysters, fowls, fruits, or vegetables for human consumption, who shall utilize in this way any diseased, tainted, or unwholesome meat, fish, oysters, fowls, or any diseased or decayed or unwholesome fruit or vegetables, or any fruit or vegetables from filthy boxes, baskets, or other container, or use any chemicals therein deleterious to health, shall be deemed guilty of violating this ordinance.

SEC. 9. It shall be unlawful for any person in charge of any restaurant, hotel, or boarding house, or other place where food is sold or served in cooked or raw state, to keep such place in an unclean or insanitary condition, and all persons employed in or about such places shall keep themselves and their clothing in a clean and healthful

condition.

SEC. 10. It shall be unlawful for any person maintaining or in charge of any restaurant, hotel, boarding house, or other place where meals or lunches are served in a cooked state or otherwise, to serve or cause to be served any tainted or diseased meat, fish, oysters, fowl, or any diseased, decayed, or partially decayed or unwholesome fruit, vegetables, or any unwholesome food whatever, to any person or persons, either at said place or sent to any person or persons to be eaten at any other place.

SEC. 11. It shall be unlawful for any person or persons to keep live chickens, ducks, geese, turkeys, or other live fowl in any cellar or basement underneath any grocery store, market, or other place where foodstuffs are kept for sale. It shall also be unlawful for any person or persons to keep any live chickens, turkeys, ducks, geese, or live fowl of any kind in any room where any kind of foodstuffs, such as are enumerated in section 2 and section 3 hereof, are kept, prepared for sale, or sold. Slaughterhouses and other places where fowl are killed and prepared for sale or storage shall be constructed with water-tight flooring, with properly trapped sewer connections, and these connected with the sewer, and immediately after each killing the floor shall be thoroughly washed and the place at all times kept in a clean and wholesome condition. SEC. 12. If the health officer, or his assistants, shall find any public or private market, stall, shop, store, bakery, storehouse, cold storage warehouse, stock yard, slaughterhouse, boat, cart, wagon, or other vehicle in an unclean or unwholesome condition, notice shall be given to the person in charge thereof to clean and purify the same, so as to put the same in a clean, wholesome, and proper sanitary condition within 24 hours from the time of such notice, and if any person so in charge shall not put the same in a clean, wholesome, and properly sanitary condition within such time, then such person shall be guilty of violating this ordinance and subject to the punishment provided therefor.

SEC. 13. Any person violating any of the provisions of this ordinance shall be guilty of a misdemeanor and, upon conviction thereof, shall be punished by a fine not to exceed $300, or by imprisonment not to exceed 60 days, or by both such fine and imprisonment.

SEC. 14. This ordinance shall take effect and be in force 30 days from and after its final passage. [Ordinance in effect May 23, 1910.]

KALAMAZOO, MICH.

FOODSTUFFS PREPARATION, CARE, AND SALE.

1. Raw or uncooked meat, poultry, game, fish and sea food, vegetables or fruit shall not be kept or offered for sale in or near an open window or doorway, outside of a building or in any street, private way, or public place in the city of Kalamazoo, unless so covered or screened as to be protected from dust and flies and from contact with animals, and no such article intended to be used as food shall be exposed or displayed in any street, private way, or public place or in front of any place of business, unless the bottom of the box or receptacle containing such articles is raised at least 2 feet above the sidewalk, platform, or landing upon which such receptacle rests. No such articles shall be carried through any street, private way, or public place in said city unless properly protected or screened from dust and flies. Every person

being the occupant as owner, lessee, or otherwise, of any room, stall, building, or place in said city where any meat, poultry, game, fish, sea food, butter, vegetables, fruit, confectionery, bakers' products or other articles intended for human food shall be kept or offered for sale, shall maintain such room, stall, building, or place and its appurtenances in a clean and sanitary condition. Every peddler of foodstuffs from wagons or carts in said city shall keep in his wagon or cart a suitable receptacle for the wastes of his business, such wastes to be disposed of in a manner that shall not create a nuisance.

2. Bread and other bakers' products shall not be transported in any manner through the streets or alleys in the city of Kalamazoo unless wrapped in suitable paper so as to protect it from contamination from contact with flies, dust, the conveyance, lines, or the hands of the driver or other person handling such bakers' product.

All bakers' products shall be suitably wrapped as above specified before leaving the bakery, by persons whose hands have been thoroughly washed and sterilized immediately preceding.

No bread or bakers' products shall be kept or offered for sale in the city of Kalamazoo which has not been handled in conformity to the requirements of this section.

3. Meat cutters or other attendants in meat shops who handle raw or uncooked meat shall be cleanly dressed, and their hands and outer garments shall be kept clean. They shall not wrap any such meat in a newspaper or any part thereof or in wrapping paper that is soiled or has been used for other purposes, but shall wrap the same in fresh, clean wrapping paper. No refuse, scrape, bones, rancid fat, or decaying flesh shall be kept in any ice box in any meat shop with any such fresh meat.

4. Live poultry shall not be kept in the same room or compartment in which meat is kept or offered for sale; nor shall live poultry be kept in any room or compartment adjoining such room or compartment if the conditions are such that the room or compartment in which the live poultry is kept ventilates or is liable to ventilate into said other room or compartment, so that the odors from the fowls and their inclosures may contaminate the meat.

5. Any person violating any provision of these rules shall be fined not less than $5 or more than $20 for every violation thereof. [Regulation, board of health, adopted May 24, 1911.]

KANSAS CITY, MO.

FOODSTUFFS-PROTECTION AND CARE.

SECTION 1. That no person, firm, or corporation shall expose for sale anywhere in Kansas City, Mo., at any time, except during the months of January, February, and December, any fruit or foodstuff which is subject to contamination from contact with flies, without covering such fruit or foodstuff with either glass or wire screening not coarser than No. 12 standard wire mesh, in such a manner as to protect such fruit or foodstuff from contact with flies, and so that said covering shall not touch such fruit or foodstuff: Provided, however, That the following fruit or foodstuff shall not be deemed subject to contamination and shall not be required to be covered, to wit: Watermelons and all other kinds of melons, oranges, lemons, bananas, potatoes, cabbages, carrots, turnips, parsnips, onions, squashes and pumpkins, and all fruits and produce brought into the city in the original package or sack so long as such package is unbroken or sack is unopened.

SEC. 2. Any person, firm, or corporation that shall fail to comply with any provisions of this ordinance shall be deemed guilty of a misdemeanor, and, on conviction, shall be fined in an amount not less than $10 nor more than $100 for each and every offense.

SEC. 3. All ordinances or parts of ordinances in conflict with this ordinance are, in so far as they so conflict, hereby repealed. [Ordinance adopted Sept. 6, 1910.]

NEWTON, MASS.

FOODSTUFFS CARE AND PROTECTION OF.

No person shall expose, sell, or offer for sale for human consumption any meat, poultry, game, fish, breadstuffs, cake, pastry, candy, fruits, dried fruits, or shelled nuts, outside of any building, nor in any open window or doorway, nor upon any alley, street, or sidewalk in the city of Newton, unless such food is so covered with clean material or so placed as to be protected from dust, flies, animals, or any other contaminating influence.

No person shall expose any fruits, vegetables, or other foodstuffs, intended for human consumption, outside of stores, markets, or places of sale, unless the stand or bottom of the container is at least 2 feet above the level of the sidewalk. [Regulation board of health, adopted Apr. 3, 1911.]

ST. JOSEPH, MO.

FOODSTUFFS-INSPECTION AND SALE.

SECTION 1. The board of health of the city of St. Joseph, through its officers and employees, shall have the power to inspect and examine articles of food and drink, and shall have the power to enter upon any property or premises for the purpose of said inspection and examination.

SEC. 2. No person shall sell, expose, or offer for sale in any public market, or in any store, shop, or any other place, within the limits of the city of St. Joseph, any unsound, diseased, stale, rotten, fermented, nauseous, or unwholesome meat, poultry, fish, vegetables, fruits, or other articles of food, provisions, or drink, or any unwholesome bread, cake, or pastry manufactured in whole or in part from unwholesome flour or meal.

SEC. 3. Every person who shall violate the provisions of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction shall be fined in any sum not more than $500. [Ordinance adopted Jan. 4, 1911.]

ST. LOUIS, MO.

FOODSTUFFS-PROTECTION AND CAre of.

SECTION 1. No person, firm, or corporation shall, at any time within the period beginning on the first day of April and ending on the first day of December in any year, place, keep, expose, offer, or prepare for sale, or shall sell, or shall store pending sale, any article or substance of human food or drink in any building, premises, or place in the city which is or are not at such times screened so as to prevent flying insects from having access to such article or substance, and no person, firm, or corporation shall, at any time, within such period in any year, place, carry, or convey, or cause to be placed, carried, or conveyed, within, upon, along, or over any street, lane, alley, or other public place or way in the city, any article or substance of human food or drink which is then, or is thereafter to be, placed, kept, offered, or exposed for sale, or stored pending sale, or which at such time is in course of delivery after sale, unless such article or substance at such time be covered, screened, or otherwise protected in such manner as not be accessible to flying insects; provided, however, that no provision hereof shall apply to or affect any article or substance of human food or drink which shall at such time be in unbroken packages or containers tightly closed.

SEC. 2. Any person, firm, or corporation violating or neglecting, failing or refusing to comply with, any of the provisions of this ordinance shall be deemed guilty of a misdemeanor, and be fined not less than $5 nor more than $25 for each and every offense. SEC. 3. It is expressly declared to be the duty of all officers and members of the police force or department, and of all officers and employees of the health board or department, and they are hereby required to take all needful and proper steps and measures to enforce the provisions of this ordinance. ST. PAUL, MINN.

FOODSTUFFS-PROTECTION of.

SECTION 1. All berries, cherries, dates, and figs exposed for sale in any store, shop, or building shall be protected from flies and all fruits, berries, and candies exposed for sale outside of a building or in any wagon or cart shall be protected from both flies and dust.

SEC. 2. Anyone violating any of the provisions of this ordinance shall be guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not less than $5 nor more than $25. [Ordinance adopted May 8, 1911.]

SAN ANTONIO, TEX.

VEGETABLES-PRODUCTION AND Sale of.

SECTION 1. That no lettuce, celery, cabbage, parsley, thyme, tomatoes, 1adishes, onions, or shallots, meaning all vegetables usually eaten raw, raised by sewage irrigation, either within or outside of the city limits, shall be sold, given away, or used within the city limits.

SEC. 2. No vegetables dealer shall expose for sale, sell, or give away any vegetables which have not been first inspected and approved as being fresh and wholesome at the market house by an inspector duly appointed by the city, and obtaining from said

inspector a certificate of inspection and approval, which said certificate shall be shown to anyone inquiring therefor: Provided, That said dealer must first produce a certificate from the grower of such vegetables, stating whether the same were raised on a sewage-irrigated farm or otherwise.

SEC. 3. If the vegetables prohibited in section 1 hereof are found within the city limits they shall immediately be condemned and destroyed by said inspector; and all vegetables offered for sale not inspected and approved as provided in section 2 hereof shall also immediately be condemned and destroyed by the inspector.

SEC. 4. Any person or persons violating any provision of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction shall be fined not less than $5 nor more than $200 for each and every offense. [Ordinance adopted Apr. 19, 1911.]

TACOMA, WASH.

FOODSTUFFS PREPARATION, care, and sale.

SECTION 1. Section 2 of ordinance No. 3610 shall read as follows:

"SEC. 2. It shall be unlawful to keep, offer for sale or expose for sale any meat, game, fish, vegetables, fruit, or prepared food products in open receptacles or broken packages less than 2 feet above the floor of any building, storeroom or place in which or where the same may be sold or offered for sale. And it shall be unlawful to keep any cured, cooked or fresh meat, game, fowl, cured, cooked or fresh fish, cheese, figs, dates, dried or fresh fruit, olives, sauerkraut, mincemeat, lard, butter, butterine, candy, crackers, cakes, bread, or any prepared food products for sale or exposed for sale unless the same be protected in such manner as to exclude as far as practicable dust, flies, or other insects from coming in contact therewith. All cut meats and fish shall be kept in cases or receptacles, having glass tops, and shall be properly ventilated. Apples, oranges, lemons, limes, and all other fruits of like kind and character and all fruits which are generally eaten in a raw state and all fresh garden vegetables shall at all times be so protected by screens or netting as to exclude flies or other insects." SEC. 2. Section 3 of ordinance No. 3610 shall read as follows:

"Sec. 3. That kitchens of all restaurants, hotels, and all candy factories, fish markets, meat markets, and bakeries shall have good and proper screens at all openings in such places where flies or other insects can enter, for the purpose of excluding such insects from the said places.

SEC. 3. Section 14 of ordinance No. 3610 shall read as follows:

"SEC. 14. No meats, fish, oysters, birds, fowls, fruits, vegetables, milk, or other provisions of any kind not being in a healthy, sound, and wholesome condition, and no part of any animal or fish that dies by accident or from disease, shall be brought in to the city of Tacoma for the purpose of sale or gift as human food nor shall the same be offered for sale by any person at or in any public or private market, store, stall, warehouse, cold storage, or other place of business." other place of business." LOS ANGELES, CAL.

BAKESHOPS AND BAKERS.

SECTION 1. Section 8 of ordinance No. 17,862 (new series), entitled "An ordinance defining and regulating bakeries and regulating the sale, delivery, and transport of the products thereof," approved March 11, 1909, is hereby amended so as to read as follows:

"SEC. 8. It shall be unlawful for any person, firm, or corporation, after the passage of this ordinance, to establish or to cause or permit to be established, any bakery in any room or place, the floor of any portion of which is more than 4 feet below the level of the adjacent street, sidewalk, or ground.

"After any room or place, the floor of any portion of which is more than 4 feet below the level of the adjacent street, sidewalk, or ground, has, for any cause, ceased to be used as a bakery, it shall be unlawful for any person, firm, or corporation to reopen such room or place or to cause or permit the same to be reopened for use as or for a bakery, or to use the same or to cause or permit the same to be used as or for a bakery.

"It shall be unlawful for any person, firm, or corporation to maintain, or to cause or permit to be maintained, any bakery established in violation of the terms of this section: Provided, however, That the provisions of this section shall not apply to any clean, well-drained, and sanitary room used exclusively for the storage of flour, meal, or other articles necessary in the preparation, baking, and cooking of bread, crackers, cakes, pies, or other breadstuffs or products of flour or meal: And provided further, That the provisions of this section shall not apply to any bakery established or maintained in any basement that is constructed as follows: Such basement shall be well ven

tilated and shall be so constructed as to prevent rats and mice from entering such basement; the floor of such basement shall be constructed of cement and the walls thereof shall be constructed of cement or of brick plastered inside."

SEC. 2. That section 17 of the said ordinance No. 17,862 (new series) be, and the same is hereby, amended so as to read as follows:

"SEC. 17. It shall be unlawful for any person, firm, or corporation to keep, or to cause or permit to be kept, any animal or fowl in any bakery or in any storage room connected or used in connection with or belonging to any bakery, or in any building in which any bakery is located, or to keep, or to cause or permit to be kept, any animal within 35 feet of any door or window or airshaft of any bakery, or within 35 feet of any door or window or airshaft of any storage room connected or used in connection with or belonging to any bakery.

"It shall be unlawful for any person, firm, or corporation to keep, or to cause or permit to be kept, any bakery or any storage room connected or used in connection with any bakery, in any building in which any animal or fowl is kept or is permitted to be or remain." [Ordinance adopted May 27, 1910.]

ST. PAUL, MINN.

BAKESHOPS AND BAKERY PRODUCTS.

SECTION 1. All bread and other bakery goods baked, made, deposited, or offered for sale, or sold, in the city of St. Paul, shall be made of good wholesome substances, and shall be kept in a proper, clean, and sanitary condition, and every bakery, bakeshop, store or other place where bread or other bakery goods are baked, made, deposited, or offered for sale, or sold in the city of St. Paul, and every vehicle or receptacle in which said bread or goods are kept or transported shall be kept in a proper, clean, and sanitary condition.

SEC. 2. The commissioner of health of said city shall examine and inspect such bread and bakery goods and each such bakery, bakeshop, store, place, vehicle, and receptacle from time to time to ascertain if such bread and bakery goods are baked or made of good, wholesome substances, and in a proper, clean, and sanitary manner, and if such bakery, bakeshop, store, or place is kept and maintained in a proper, clean, and sanitary manner, and may enter any such bakery, bakeshop, store, or place and stop any such vehicle or any person carrying or transporting any such bread or goods at all reasonable hours, to make such examination and inspection, and may seize and destroy any and all such bread and bakery goods baked, made, deposited, or offered for sale, or transported contrary to the provisions of this ordinance. SEC. 3. This ordinance shall not be deemed to amend or repeal any ordinance or law now in force.

SEC. 4. Any person violating the provisions of this ordinance shall be guilty of a misdemeanor, and upon conviction thereof shall be subject to a fine of not less than $5 nor more than $25 or by imprisonment for not less than 5 days nor more than 25 days. [Ordinance adopted May 16, 1911.]

SAN FRANCISCO, CAL.

BAKESHOPS AND BAKERY PRODUCTS.

SECTION 1. It shall be unlawful for any person, firm, or corporation to conduct and maintain or carry on, or cause to be conducted, maintained, or carried on, any bakery, store, shop, or stand where there is to be received or delivered bread or other bakery products, unless the said bakery, store, shop, or stand be provided with proper receptacles for bread or other bakery products, as herein provided.

SEC. 2. Every bakery, store, shop, or stand where bread or other bakery products of any kind are received or delivered shall be provided with a wooden receptacle for the reception and protection of bread or other bakery products, and into which all bread or other bakery products shall be placed when delivered, as herein provided.

SEC. 3. (a) The said receptacle for the reception of bread or other bakery products as aforesaid shall be constructed of clear pine board, dressed on both sides, and shall have not less than two coats of paint on the outside. The outside must present a smooth surface, with no bottom or side moldings thereon. The receptacle shall be furnished with four bent iron legs, each two inches in height, fastened to two cleats which shall extend across the bottom of the receptacle, 1 inch from the ends of the receptacle, and the ends of said cleats shall extend to within 1 inch from the side thereof. The inside corners shall be filled and reenforced with right-angle pine uprights with smooth surfaces to exclude dust accumulating in corners of receptacle.
