MISBRANDING OF EVAPORATED APPLES.

Underweight.

The facts in the case were as follows:

On or about January 19, 1909, an inspector of the Department of Agriculture located in the possession of L. Kahn, Marshall, Tex., 65 cases of evaporated apples, labeled, "Choice Evaporated Apples, 48 1-lb. Cartons, Michael Doyle & Co., Rochester, New York, Favorite Brand." The goods had been shipped to L. Kahn by the Silbernagel Company (Limited), Shreveport, La., on December 10, 1908. A representative number of cartons was weighed by the inspector and the average net weight of each package was found to be 13 5-6 ounces, and in no instance was the gross weight of the packages found to equal one pound. As the statement was made in the label on each case that the individual packages contained therein weighed 1 pound each, the goods were misbranded in violation of section 8 of the act, and on January 20, 1909, the facts were reported by the Secretary of Agriculture to the United States attorney for the eastern district of Texas, who filed a libel for seizure and condemnation of the goods, with the result that said 57 cases of evaporated apples be condemned and forfeited, as provided for in said act of June 30, 1906. It is provided however, that upon the payment of all costs of this proceeding and the execution of a good and sufficient bond in the penal sum of one thousand dollars, conditioned that the said 57 cases of evaporated apples with contents shall not be sold or otherwise disposed of contrary to the provisions of said act of June 30, 1906, or to the laws of any state, territory, District or similar possessions.

MISBRANDING OF CANNED PEAS.

Underweight.

The facts in the case were as follows:

On or about January 29, 1909, an inspector of the Department of Agriculture located in the possession of J. F. Humphreys & Co., Bloomington, Ill., 150 cases (each containing 24 cans) of peas labeled “2 doz. 2 lb. Sweet Wisconsin Brand Marrow fat Peas, The Reynolds Preserving Company, Sturgeon Bay, Wisconsin," and 150 cases (each containing 24 cans) of peas labeled “2 doz. 2 lb. Sweet Wisconsin Brand Telephone l'eas, The Reynolds Preserving Company, Sturgeon Bay, Wisconsin." A representative number of the cans was weighed by the inspector, and the average gross weight of each can was found to be 25

ounces.

The facts were reported by the Secretary of Agriculture to the United States attorney for the southern district of Illinois, and a libel for seizure and condemnation was duly filed, with the result that 342 cases of peas with the contents are hereby declared misbranded in violation of act of June 30, 1906. It is provided however, that upon the payment of all costs of the proceeding herein, and the execution and delivery to the libelant of a good and sufficient bond in a penalty of one thousand dollars, conditioned that the said three hundred and forty-two cases of peas shall not be sold or otherwise disposed of contrary to the provisions of said act of June 30, 1906.

Importation of Coffee.

The Department has recently investigated the sale and shipment, within. the jurisdiction of the Food and Drugs Act of June 30, 1906, of decomposed, imperfect and damaged coffee. A public hearing on this subject was held by the Board of Food and Drug Inspection on December 15, 1908, at which an opportunity to be heard was given to the trade and to the public.

As a result of the investigation and the evidence adduced at the hearing, it is anounced that the product ordinarily known as "Black Jack," consisting of rotten or decomposed berries, is regarded by the Department as injurious to health and the Food and Drugs Act forbids its shipment or sale within the jurisdiction of the said act. Coffee which is damaged by water during shipment, or which has acquired a permanently offensive odor because of its proximity to hides or other material of objectionable odor, is considered by the Department to come within the phrase "filthy, decomposed, or putrid," within the meaning of that phrase as used in the Food and Drugs Act, and its shipment or sale as hereinbefore stated is, therefore, held to be forbidden. Immature berries, ordinarily known as "Quakers," are dead beans without pronounced smell or taste. They have not the characteristics of coffee, and, in the opinion of the Department, their shipment or sale as coffee within the jurisdiction of the act is in violation thereof.

It is recognized that the ordinary coffees of commerce usually contain small quantities of these inhibited products, and no action will be taken in regard to the shipment or sale of the recognized graded coffees of commerce because of the small amount of these substances which may be present. In determining the present action of the Department on any particular lot as to whether it contains more than the ordinary small quantities of the inhibited products, coffee graded as No. 8, on the New York Coffee Exchange, will be taken as a standard.

Screenings consisting of inferior or broken berries, of stones, sticks, dirt, etc., should not be sold as coffee even in a ground condition. This product should be designated as "Coffee screenings."

SPECIAL NOTICE. DENVER CONVENTION. The Association of State & National Food & Dairy Departments of the United States is to meet at Convention, Denver, Colorado, August 24th, to 27th, 1909.

Important food problems will be debated upon. The Convention is of greatest importance and it is expected the attendance will be unusually large.

On account of the distance to be traveled it has been deemed advisable to make some special arrangements for the accommodation of those who desire to avail themselves of same. It is hoped many will take advantage of this special service as it will add materially to the pleasurable features of the trip by securing pleasant and congenial company enroute, and at the same time securing the best of service.

From Cincinnati, special sleeping cars will be provided which will run through to Denver if the volume of business justifies, via Big 4 Route, C. & N. W. and U. P. Additional special sleepers will start from Chicago on the Chicago and North Western and the Union Pacific Line.

It is proposed to leave Cincinnati at 9:10 P. M. August 20th, Big 4 Route. Arriving Chicago 7:10 A. M. August 21st. Breakfast Chicago. Leave Chicago at 10:00 A. M. via Chicago and North Western Union Pacific Line (Colorado Special) arriving in Denver 3:00 P. M. August 22nd.
