THIS AGREEMENT executed this March 19, 1914, by and between the City of Boston (hereinafter referred to as the "City"), acting through the Commissioner of Public Works, party of the first part, and the Boston Consolidated Gas Company (hereinafter referred to as the "Company"), party of the second part:

Witnesseth: That said parties each in consideration of the agreements and promises of the other do hereby agree that the city shall purchase from the company and that the company shall sell to the city illuminating gas for the lighting of gas lamps in certain streets, parks, alleys and public places upon terms and conditions as follows:

1. The company agrees to furnish to the city delivered at the lamp-posts connecting with the mains of the company all the illuminating gas required for lighting with single and double burner gas incandescent mantle lamps such streets, parks, alleys and public places as may from time to time be designated by the city during the continuance of this contract.

2. The city agrees to pay for the gas so furnished by the company at the rate of nine dollars ($9.00) per lamp per year for single-burner 60 candle power lamps, and eighteen dollars ($18.00) per lamp per year for double-burner 100 candle power lamps.

It is understood that the hours of lighting will not exceed 4,000 hours per year.

The number of lamps for which gas is furnished by the company for any year or portion thereof shall be determined by the company and the official of the city in charge of street lighting. The payments due under this contract shall be made to the company in monthly instalments on or before the tenth of each month beginning in the second month of the period of the contract.

3. The company agrees that if, after the execution and before the expiration of this contract, it shall at any time reduce the maximum price of gas charged by it to its regular consumers to a price less than eighty (80) cents per thousand cubic feet, it will make to the city a rebate from the price of gas specified above at the rate of twelve (12) cents per lamp per year for each one (1) cent by which such price is so reduced below eighty (80) cents per thousand cubic feet for any period during which any such reduction is in effect.

4. This contract shall be in force for a period of ten (10) years beginning on April 1, 1914, and terminating on March 31, 1924.

In Witness Whereof the City of Boston has caused this agreement to be executed in its name and behalf by its Commissioner of Public Works and the Boston Consolidated Gas Company has caused this agreement to be executed in its name and behalf by E. N. Wrightington, its second vice president, thereunto duly authorized.

After a public hearing, of which seven days' notice was given in the City Record, held by the City Council on April 22, 1914, it was voted by the City Council, on June 11, 1914, to approve the foregoing contract.

BOND.

The undersigned surety company hereby binds itself, its successors and assigns, to pay to the City of Boston the sum of eight thousand dollars ($8,000).

This obligation is upon the condition that if the party to the contract hereto annexed, other than the city, shall faithfully furnish and do everything therein required of the party on his part to be kept and performed, and shall also pay for all labor performed or furnished, and for all materials used in the carrying out of said contract, then this obligation shall become and be null and void; otherwise it shall be and remain in full force and virtue.

AGREEMENT SUBMITTED BY THE BOSTON CONSOLIDATED GAS COMPANY AND PLACED ON FILE BY THE CITY COUNCIL JUNE 11, 1914.

BOSTON, MASS., June 10, 1914.

In consideration of the execution of the two contracts dated March 19, 1914, for the supply of gas for street lighting purposes and for the maintenance of street lamps, the Boston Consolidated Gas Company hereby agrees that said contracts may be terminated on April 1, 1919, by the City of Boston in pursuance of a vote of the City Council approved by the Mayor after a public hearing held as provided in section 6 of chapter 486 of the Acts of 1909, provided written notice of such vote to terminate is given by the Mayor of Boston to the Boston Consolidated Gas Company any time between March 1, 1918, and July 1, 1918; otherwise said contracts shall continue in full force and effect for the full term provided therein.
