For the purpose of determining the employees holding permanent appointment in the competitive class positions to be transferred, such employees shall be selected within each class of positions in the order of their original appointment, with due regard to right of preference in retention of disabled and nondisabled veteran. Any such employee who, at the time of such transfer, has a temporary or provisional appointment shall be transferred subject to the same right of removal, examination or termination as though such transfer had not been made. Employees holding permanent appointments in the competitive class positions who are not transferred pursuant to this section shall have their names entered upon an appropriate preferred list for reinstatement pursuant to the civil service law. For the purpose of succession to all functions, powers, duties and obligations transferred and assigned to, devolved upon and assumed by the department of health pursuant to this authorization, they shall be deemed and held to constitute the continuation of the department of labor pertaining to the functions herein transferred. Any business or other matter undertaken or commenced by the department of labor pertaining to or connected with the functions, powers, obligations and duties herein transferred and pending on the effective date of the transfer, may be conducted and completed by the department of health in the same manner and under the same terms and conditions and with the same effect as if conducted and completed by the department of labor. All rules, regulations, acts, ordinances, determinations and decisions of the department of labor pertaining to the functions herein transferred, in force at the time of such transfer, assignment, assumption or devolution shall continue in force and effect as rules, regulations, acts, determinations and decisions of the department of health for functions transferred therein until duly modified or abrogated by the department of health. Wherever the department of labor is referred to or designated in any law, contract or document pertaining to the functions, powers, obligations and duties herein transferred, such reference or designation shall be deemed to refer to the department of health. No existing right or remedy of any character shall be lost, impaired or affected by reason of this transfer. No action or proceeding pending at the time when this transfer shall take effect, brought by or against the industrial commissioner or department of labor pertaining to the functions transferred herein shall be affected by any provision of this authorization, but the same may be prosecuted or defended in the name of the department of health, and upon application to the court, such department of health shall be substituted as a party. All appropriations for the functions herein transferred heretofore made to the department of labor to the extent of the remaining unexpended or unencumbered balances thereof at the time of transfer, whether allocated or unallocated and whether obligated or unobligated, are hereby authorized to be transferred to and made available for use and expenditure by the department of health subject to the approval of the director of the budget for the same purposes for which originally appropriated, and shall be payable on vouchers certified or approved by the commissioner of the department of health on audit and warrant of the comptroller. Payments for liabilities for expenses of personal service, maintenance and operation theretofore incurred by the department of labor in connection with the functions herein transferred, and for liabilities incurred and to be incurred in completing its affairs in relation to the functions transferred herein, shall also be made on vouchers or certificates approved by the commissioner of the department of health on audit and warrant of the comptroller.
