To supplement the state share of the cost of a project listed in the above schedule in the event that such project is declared ineligible for Federal participation or that Federal funds apportioned or allocated to the State are insufficient to provide Federal assistance in the amount estimatel for such project or projects or that the lowest acceptable bid or bids received exceed the estimated project cost and such project is deemed urgent and necessary by the Commissioner of Transportation provided, however, that the estimated costs of any item or items in the above schedule may not be increased by interchange with any other item or items; and for payment of the expenses of preparing and selling bonds pursuant to section 63 of the State finance law..

Advances to Commissions and Public Authorities

ALBANY PORT DISTRICT COMMISSION

By chapter 170, section 19, of the laws of 1967, as amended by chapter 68, section 15, of the laws of 1968 and as reappropriated by chapter 34, section 10, of the laws of 1972:

Advance for: The Albany port district commission for construction, reconstruction and rehabilitation of port facilities under the jurisdiction of the commission.

Notwithstanding the provisions of any general or special law, no part of any such appropriation shall be available for the purposes designated until a certificate of approval of availability shall have been issued by the director of the budget and a copy of such certificate filed with the state comptroller, the chairman of the senate finance committee and the chairman of the assembly ways and means committee. Such certificate may be amended from time to time subject to the approval of the director of the budget and a copy of each such amendment shall be filed with the state comptroller, the chairman of the senate finance committee and the chairman of the assembly ways and means committee.

The director of the burget shall not issue any certificate of approval of availability until the Albany port district commission has entered into a written agreement with the director of the budget providing that such Albany port district commission shall reimburse the state of New York in full for all moneys advanced by the State from this appropriation from the revenues of the commission or any other sources available to such commission and further providing (1) any annual net revenue in excess of the previous five year average shall be used to reduce the balance of the moneys advanced to the commission and (2) each such annual principal payment shall equal at least five per centum of all moneys advanced pursuant to this appropriation. However, the State shall be reimbursed in full for all expenditures from this appropri ation not later than March thirty-first nineteen hundred eighty-nine.

The state comptroller is hereby authorized to receive from the commission amounts of money equal to the amounts expended from this appropriation and to deposit the same to the credit of the capital construction fund.

The moneys hereby appropriated, when made available pursuant to the certificate of approval of availability issued by the director of the budget shall be paid from the capital construction fund on the audit and warrant of the comptroller on vouchers approved by the commissioner of transportation and the chairman of the Albany port district commission.....(re. $2,291)

NEW YORK STATE BRIDGE AUTHORITY The appropriation made by chapter 320, section 15, of the laws of 1971 and as reappropriated by chapter 54, section 8, of the laws of 1973 is hereby amended and reappropriated to read: The sum of two million three hundred thousand dollars ($2,300,000), or so much thereof as may be necessary is hereby appropriated in the first instance from the capital construction fund and authorized to be paid as herein provided to the Department of Transportation as an advance subject to repayment to the New York State bridge authority for the authority's share of costs of planning, design, land acquisition [and], preliminary engineering studies, including subsurface investigations, in connection with the] and construction of a parallel Newburgh-Beacon Bridge together with incidental roads, approaches, structures and facilities as may be necessary. Notwithstanding the provisions of any general or special law, no part of this appropriation shall be available for the purposes designated (a) until the New York State bridge authority has entered into a written agreement with the director of the budget providing that such New York State bridge authority shall reimburse the state of New York in full for all monies advanced by the State from this appropriation at such times and in such manner as shall be determined by the director of *So in original. The monies hereby appropriated, when made available pursuant to a certificate of approval of availability issued by the director of the budget, shall be paid from the capital construction fund on the audit and warrant of the state comptroller on vouchers approved by the commissioner of transportation and the chairman of the New York State bridge authority or their duly designated officers... CAPITAL DISTRICT TRANSPORTION* AUTHORITY By chapter 157, section 13, of the laws of 1970, and chapter 34, section 10, of the laws of 1972 is hereby amended and reappropriated to read:

[Advance subject to repayment to the Capital District Transportation Authority, created by a section of the laws of 1970, for services and expenses and other costs in performing its corporate purposes in regard to planning, continuing, development and improvement of transportation and related services within the Capital District transportation district.

TRANSPORTATION AUTHORITY

By chapter 320, section 15, of the laws of 1971, and chapter 34, section 10, of the laws of 1972 is hereby amended and reappropriated to read:

Notwithstanding the provisions of any general or special law, no part of any such appropriation shall be available for the purposes designated until a certificate of approval of availability shall have been issued by the director of the budget, and a copy of such certificate filed with the state comptroller, the chairman of the senate finance committee and the chairman of the assembly ways and means committee.
