CHAPTER 54 AN ACT making appropriations for the support of government (CAPITAL PROJECTS BUDGET) Became a law April 16, 1985, with the approval of the Governor. Passed on message of necessity pursuant to Article III section 14 of the constitution by a majority vote, three-fifths being present. The People of the State of New York, represented in Senate and Assembly, do enact as follows: CAPITAL PROJECTS Section 1. The amounts of moneys specified in this section or so much thereof as shall be necessary to accomplish the purpose of the appropriations are appropriated by comprehensive construction programs (hereinafter referred to by the abbreviation CCP), CCP), purposes, and projects designated by the appropriations and authorized to be made available as hereinafter provided to the respective public officers and shall be deemed to provide all costs necessary and pertinent to accomplish the intent of the appropriations including apportionments to departments or agencies for the purposes of the specific appropriations. Appropriations from the Capital Projects Fund and the Federal Capital Projects Fund are appropriated in accordance with the provisions of section 93 of the state finance law. Moneys herein appropriated from each such fund type for comprehensive construction programs, for agency purposes within comprehensive construction programs, and for projects sharing the same agency purpose within a comprehensive construction program may be transferred among projects within a comprehensive construction program in accordance with paragraphs (a) through (g) of subdivision of section 93 of the state finance law and may be transferred among purposes within a comprehensive construction program subject to the limitations of paragraph (e) of subdivision 4 of section 93 of the state finance law. 93 Notwithstanding the provisions of any general or special law, the provisions of paragraphs (a) through (g) of subdivision 4 of section of the state finance law which relate to the transfer of a portion of a capital appropriation to another capital appropriation shall be applicable to appropriations in this section appropriated from each fund. The comptroller is hereby directed to include in the quarterly capital projects reports subtotals of the information by agency for each comprehensive construction program, for each purpose within a comprehensive construction program, and for each project sharing the same purpose within a comprehensive construction program as herein appropriated in accordance with subdivision 9-c of section 8 of the state finance law. The comptroller is hereby authorized and directed to loan money by transfer to the Federal Capital Projects Fund from the general fund or any other fund, which loans shall be limited to the amounts immediately required to meet disbursements, made in pursuance of an appropriation by EXPLANATION-Matter in italics is new; matter in brackets [ ] is old law CAPITAL PROJECTS law and authorized by a certificate of approval issued by the director of the budget with copies thereof filed with the comptroller and the chairmen of the senate finance committee and the assembly ways and means committee. The director of the budget shall not issue such a certificate unless he shall have determined that the amounts to be so transferred are receivable on account or are otherwise readily available for payment. When making loans, the comptroller shall establish appropriate accounts and if the loan is not repaid by the end of the month, provide on or before the fifteenth day of the following month to the director of the budget, the chairmen of the senate finance committee and the bly ways and means committee, an accurate accounting and reporting of the financial resources of each such fund at the end of such month. Within ten days of the receipt of such accounting and reporting, the director of the budget shall provide to the chairmen of the senate finance committee and the assembly ways and means committee an expected schedule of repayment by fund and by source for each outstanding loan. Repayment shall be made by the comptroller by transfer of the first cash receipts of this fund. assem The appropriations herein contained shall be available for the fiscal year beginning on the first day of April, nineteen hundred eighty-five.
