concluded, accorded, and agreed upon, by and between the faid parties, that all matters, that by thefe articles are agreed upon to be paffed in parliament, fhall be tranfmitted into England, according to the ufual form, to be paffed in the faid parliament, and that the faid acts fo agreed upon, and fo to be paffed, fhall receive no disjunction or alteration here in England; provided that nothing fhall be concluded by both or either of the faid houses of parliament, which may bring prejudice to any of his majefty's Proteftant party, or their adherents, or to his majefty's Roman Catholic fubjects, or their adherents, other than fuch things as upon this treaty are concluded to be done, or fuch things as may be proper for the committee of privileges of either or both houses to take cognizance of, as in fuch cases heretofore hath been accustomed; and other than fuch matters as his majefty will be graciously pleased to declare his further pleasure in, to be paffed in parliament for the fatisfaction of his fubjects; and other than fuch things as fhall be propounded to either or both houses by his majefty's lord lieutenant or other chief governor or governors of this kingdom for the time being, during the faid parliament, for the advancement of his majefty's fervice, and the peace of the kingdom; which claufe is to admit no conftruction which may trench upon the articles of peace or any of them; and that both houfes of parliament may confider what they shall think convenient touching the repeal or fufpension of the statute, commonly called Poyning's Act, intitled, An Act that no parliament be holden in that land, until the Acts be certified into England.

III. Item, It is further concluded, accorded, and agreed upon, by and between the faid parties, and his majefty is graciously pleased, that all acts, ordinances, and orders, made by both or either houfes of parliament, to the blemish, difhonour, or prejudice of his majefty's Roman Catholic fubjects of this kingdom, or any of them, fince the 7th Auguft 1641, fhall be vacated; and that the fame, and all exemplifications and other acts which continue the memory of them, he made void by act to be paffed in the next parliament to be held in this kingdom: and that in the mean time the faid acts or ordinances, or

any

any of them, fhall be no prejudice to the faid Roman Catholics, or any of them.

IV. Item, It is alfo concluded, and agreed upon, and his majesty is likewife graciously pleafed, that all indictments, attainders, outlawries in this kingdom, and all the proceffes and other proceedings thereupon, and all letters patents, grants, leafes, cuftoms, bonds, recognizances, and all records, act or acts, office or offices, inquifitions, and all other things depending upon, or taken by reafon of the faid indictments, attainders, or outlawries, fince the 7th day of Auguft, 1641, in prejudice of the faid Catholics, their heirs, executors, adminiftrators, or affigns, or any of them, or the widows of them, or any of them, fhall be vacate:l and made void in fuch fort as no memory fhall remain thereof, to the blemish, difhonour, or prejudice of the faid Catholics, their heirs, executors, adminiftrators, or affigns, or any of them; or the widows of them, or any of them; and that to be done when the faid Thomas lord viscount Dillon of Coftologh, lord president of Connaght, Donnogh lord vifcount Mufkerry, Francis lord baron of Athunry, Alexander Mac-Donnel efquire, fir Lucas Dillon knight, fir Nicholas Plunket knight, fir Richard Barnwall baronet, Jeffery Brown, Donnogh O Callaghan, Tyrlah O Neal, Miles Reilie, and Gerrald Fennell, efquires, or the major part of them, fhall defire the fame, fo that by poffibility it may be done and in the mean time, that no fuch indictments, attainders, outlawries, proceffes, or any other proceedings thereupon, or any letters patents, grants, leafes, cuftodiums, bonds, recognizances, or any record or acts, office or offices, inquifitions, or any other thing depending upon, or by reafon of the faid indictments, attainders, or outlawries, fhall in any fort prejudice the faid Roman Catholics, or any of them, but that they and every of them shall be forthwith, upon perfection of these articles, restored to their respective poffeffions and hereditaments respectively; provided, that no man fhall be queftioned, by reafon hereof, for mefne rates or wastes, faving wilful waftes committed after the first day of May last past.

and his majesty is graciously pleased, that as foon as poffible may be, all impediments, which may hinder the faid Roman Catholics to fit or vote in the next intended parliament, or to choose, or to be chofen knights and burgeffes, to fit or vote there, fhall be removed, and that before the faid parliament.

VI. Item, It is concluded, accorded, and agreed upon, and his majesty is further gracioufly pleased, that all debts fhall remain as they were upon the twenty-third of October, 1641. Notwithstanding any difpofition made or to be made, by virtue or colour of any attainder, outlawry, fugacy, or other forfeiture; and that no dif pofition or grant made, or to be made of any fuch debts, by virtue of any attainder, outlawry, fugacy, or other forfeiture, fhall be of force; and this to be paffed as an act in the next parliament.

VII. Item, It is further concluded, accorded, and agreed upon, and his majesty is graciously pleased, that for the fecuring of the eftates or reputed eftates of the lords, knights, gentlemen, and freeholders, or reputed freeholders, as well of Connaght and county of Clare, or country of Thomond, as of the counties of Limerick and Tipperary, the fame to be fecured by act of parliament, according to the intent of the twenty-fifth article of the graces granted in the fourth year of his majesty's reign, the tenour whereof, for fo much as concerneth the fame, doth enfue in thefe words, viz. We are graciously pleafed, that for the inhabitants of Connaght and country of Thomond and county of Clare, that their feveral eftates thall be confirmed unto them and their heirs against us, and our heirs and fucceffors, by act to be paffed in the next parliament to be holden in Ireland, to the end the fame may never hereafter be brought into any further quefiion by us, or our heirs and fucceffors. In which act of parliament fo to be paffed, you are to take care, that all tenures in capite, and all rents and fervices as are now due, or which ought to be anfwered unto us out of the faid lands and premifes, by any letters patent paffed thereof fince the firft year of king Henry VIII. or found by any office taken from the faid firft year of king Henry VIII, until the twenty-firft of July 1645,

whereby our late dear father, or any his predeceffors actually received any profit by wardship, liveries, primerfeifins, mefne rates, oufterlemains or fines of alienation without license, be again referved unto us, our heirs and fucceffors, and all the reft of the premises to be holden of our caftle of Athlone by knight's fervice, according to our faid late father's letters, notwithstanding any tenures in capite found for us by office, fince the twenty-first of July 1615, and not appearing in any fuch letters patent, or offices; within which rule his majefty is likewife gra ciously pleased, that the faid lands in the counties of Limerick and Tipperary be included, but to be held by fuch rents and tenures only, as they were in the fourth year of his majefty's reign; provided always, that the faid lords, knights, gentlemen, and freeholders of the faid province of Connaght, county of Clare, and country of Thomond, and counties of Tipperary and Limerick, shall have and enjoy the full benefit of fuch compofition and agreement which fhall be made with his most excellent majefty, for the court of wards, tenures, refpites and iffues of homage, any claufe in this article to the contrary notwithstanding. And as for the lands within the coun ties of Kilkenny and Wickloe, unto which his majefty was intitled by offices, taken or found in the time of the earl of Strafford's government in this kingdom, his ma jefty is further gracioufly pleafed, that the flate thereof fhall be confidered in the next intended parliament, where his majefty will affent unto that which shall be juft and honourable; and that the like act of limitation of his majefty's titles, for the fecurity of the eftates of his fubjects of this kingdom, be paffed in the faid parlia ment, as was enacted in the twenty-firft year of his late majefty king James his reign in England.

VIII. Item, It is further concluded, accorded, and agreed upon, and his majefty is further graciously pleased, that all incapacities impofed upon the natives of this kingdom or any of them, as natives, by any act of parliament, provifoes in patents or otherwife, be taken away by act to be paffed in the faid parliament; and that they may be enabled to erect one or more inns of court in or near the city of Dublin or elfewhere, as fhall be thought

fit by his majesty's lord lieutenant, or other chief gover nor or governors of this kingdom for the time being; and in cafe the faid inns of court fhall be erected before the first day of the next parliament, then the fame shall be in fuch places as his majeity's lord lieutenants or other chief governor or governors of this kingdom for the time being, by and with the advice and confent of the faid Thomas lord viscount Dillon of Coftologh, lord prefident of Connaght, Donnogh lord viscount Mufkerry, Francis lord baron of Athunry, Alexander Mac-Donnell efquire, fir Lucas Dillon knight, fir Nicholas Plunket knight, fir Richard Barnwall baronet, Jeffery Browne, Donnogh O Callaghan, Tyrlah O Neile, Miles Reily, Gerrald Fennell, efquires, or any seven or more of them, fhall think fit; and that fuch ftudents, natives of this. kingdom, as shall be therein, may take and receive the ufual degrees accustomed in any inns of court, they taking the enfuing oath viz., “I Ă. B. do hereby acknowledge, profefs, teftify, and declare in my confcience before God and the world, that our fovereign lord king Charles is lawful and rightful king of this realm, and of other his majefty's dominions and countries; and I will bear faith and true allegiance to his majefty, and his heirs and fucceffors, and him and them will defend to the utmoft of my power againft all confpiracies and attempts whatfoever, which thall be made againft his or their crown and dignity; and do my best endeavour to disclose and make known to his majefty, his heirs and fucceffors, or to the lord deputy, or other his majefty's chief governor or governors for the time being, all treafon or traiterous confpiracies, which I fhall know or hear to be intended against his majefty or any of them. And I do here make this recognition and acknowledgment heartily, willingly, and truly, upon the true faith of a chriftian; fo help me God, &c." And his majesty is further graciously pleafed, that his majesty's Roman Catholic fubjects may erect and keep free schools for education of youths in this kingdom, any law or ftatute to the contrary notwithfianding; and that all the matters affented unto in this article be paffed as acts of parliament in the faid next parliament.
